Bir otel projesini sürdüren firmanın müteahhitliğini üstlenen firmanın şantiyesi önünde bir basın açıklaması yapıldı. Basın açıklamasında mahkeme kararına rağmen inşaatın devam etmesine tepki gösterilerek şu ifadelere yer verildi;

"Bugünkü yürüyüşümüze çağrı yaparken, şunları demiştik: Bodrum’a, kente karşı işlenen suçları teşhir etmek için yürüyeceğiz. Kentsel mekâna, çevreye, kültürel/tarihi dokuya ve halkın ortak kullanım alanlarına zarar veren, yaşam kalitesini düşüren fiziksel ve hukuki müdahaleler kente karşı işlenen suçlar olarak tarif edilmektedir. Bu suçlar, sadece fiziksel çevreye değil, aynı zamanda kentlilerin huzuruna, sağlık hakkına ve kentin ortak mirasına karşı işlenmiş sayılmaktadır.

Dolayısıyla, hukuksuz imar planları, kıyıların halka kapatılması, hazine arazilerinin gaspı, sermayeye peşkeş çekilmek için turizm tahsis alanları yaratılması, masalarda alınan rant kararları, ormanların yok edilmesi, derelerin kurutulması, dağların, tepelerin parçalanarak betonlaşması, deniz çayırları başta olmak üzere deniz ekosisteminin bozulması; su, elektrik, alt yapı için başka ekosistemlerin yok edilmesi (taş ocakları, beton santralleri, barajlar yapılması), pinar, ardıç, sakız, keçi boynuzu gibi bin bir çeşit bitkinin yaşam alanlarının yok edilmesi ve neticede her açıdan sağlığını yitirmekte olan Bodrum’un feryadı için buradayız.

İşte şimdi bu suçlardan sadece bir tanesinin, normalde vasfı orman olan, içinde zeytin de barındıran alanı, otel inşaatı için yok eden Kalyon Holding girişimlerinin önündeyiz. Muğla Büyükşehir Belediyesi, Bodrum Kızılağaç mevkiindeki projeyi de kapsayan 1/1000 ölçekli koruma amaçlı uygulama imar planı ve 1/5000 ölçekli koruma amaçlı nazım imar planı değişikliklerine karşı dava açmıştı. Muğla 1. İdare Mahkemesi'nin Kalyon Holding’in müteahhitliğini üstlenen Yalıköy Turizm A.Ş.’ye ait otel projesinin imar planlarını 2025/1518 sayılı kararıyla iptal ettiği, kamuoyuna 16 Ocak 2026 tarihinde duyuruldu. Mahkeme, söz konusu plan değişikliklerinin hukuka, şehircilik ilkelerine ve kamu yararına uygun olmadığına hükmederek planların iptaline karar vermiştir.

Öbür yandan, hemen arkasında yine aynı holding bünyesindeki başka bir şirkete ait başka bir otel projesi de, ÇED yönetmeliği EK-1’e takılmamak için gibi gözüken biçimde Bakanlık’tan EK-2’den işlem görecek kapasitelerle geçmiş, yerelde de bu şekilde işlem görmüş ve inşaata devam etmektedir. Neticede 308 oda kapasiteli proje, 248 + 60 oda şeklinde iki ayrı proje gibi sunulup onaylar almıştır. Bu, mevzuata uygun gibi gözüken lakin hukukun esnetildiği yüzlerce örnekten sadece biridir. Hukuksuz ve etraftan dolanan iş ve işlemler varsa, burada suç vardır.

SORUYORUZ

1) Mahkemenin plan iptaline rağmen, bu inşaat faaliyetleri nasıl devam etmektedir? Künye tabelasında yazan “305 Ada 8 Parsel için, 21.04.2025 tarihinde Bodrum Belediyesi tarafından verilen 'ruhsat'ın, iptal edilmesi gerekmiyor mu?

2) Yapı ruhsatı yasal sürece uygun verilip verilmediği hakkında, kamuoyuna bilgi verilmeli.

3) Edildi ise, kamuoyuna neden duyurulmamıştır?

4) Mühürleme yapıldıysa, inşaat hala nasıl sürmektedir?

5) Ve hangi güce dayanarak inşaatı sürdürmektedir?

6) Kıyı şeridini ihlal etmekle kalmayıp, sahile doğal yapısına aykırı malzeme döktüğünü fotoğraflarla tespit edip, belediyeye bildirimde bulunmamız akabinde, ne gibi işlemlerde bulunulmuştur?

7) Bölgede iki ayrı turizm tahsis alanı bulunduğu ve bu alanlar için ruhsat süreçlerinin devam ettiği iddiaları doğru mudur? Çok net cevap istiyoruz!

8) Eğer ikinci tahsis varsa, ona da dava açıldı mı?

9) Açılmadı ise, neden açılmadı?

Sonuç olarak Muğla Büyükşehir Belediye Başkanı Ahmet Aras tarafından davası açılarak, iptal edilen imar planları 'ısrarlı bir idari-hukuki takibin ürünüdür.' Sürecin devamını gerek Muğla Büyükşehir Belediyesi gerekse Bodrum Belediyesi’nden bekliyoruz.

Ve diyoruz ki; Sevgili Bodrumlular, bu topraklar sadece çevreye, doğaya duyarlı bir avuç gönüllüye ait değil. Bu topraklar sizin de, bizim de, hepimizin ve bütün canlıların. Bodrum yıllar içinde çok yara aldı, hor kullanıldı, doğası tahrip edildi. Başta söylediğimiz gibi, her birimizin huzurla, sağlıklı bir çevrede yaşama hakkı ihlal edilir, bu kentin doğal, kültürel, tarihi, sosyal ortak mirasları geri dönüşsüz yıkıma uğrar haldeyiz. Turizm adına bir 'dünya markası' olma iddiası; dünyanın her yerinden birbirinin aynı tesislerle, kimliğini, özelliğini yitiren bir Bodrum’la 'cılız bir söylem' olmaktadır.

Bodrum’un ne yazık ki bir turizm politikası bile yoktur. Proje ve parsel bazlı yaklaşımlarla idare edilmektedir. Bir vitrin tasarımı vardır, lakin politikası yoktur.

'Artık yeter' diyerek, bu memlekete sahip çıkmanız için, bir kez daha çağrıda bulunuyoruz. Biz yılmayacağız. Sadece burası değil, her türlü hukuksuz, kaçak ve sadece rant için peşkeş çekilen her yerde sesimizi duyuracağız. 'Yaşamak bir ağaç gibi tek ve hür ve bir orman gibi kardeşcesine' diyoruz. "We Are Exposing Crimes Committed Against the City" March

The Muğla Environmental Platform (MUÇEP) and the Bodrum Labor and Democracy Forces organized a march titled "We Are Exposing Crimes Committed Against the City." Details in the news...

A press conference was held in front of the construction site of the company undertaking a hotel project. The press statement expressed outrage at the continuation of construction despite a court order, stating the following:

"When we called for today's march, we said the following: We will march to expose the crimes committed against Bodrum and the city. Physical and legal interventions that harm urban space, the environment, the cultural/historical fabric, and public spaces, and that reduce the quality of life, are defined as crimes against the city. These crimes are considered to have been committed not only against the physical environment but also against the peace of the city dwellers, their right to health, and the common heritage of the city.

Therefore, illegal zoning plans, the closure of coastlines to the public, the usurpation of treasury lands, the creation of tourism allocation areas to be handed over to capital, rent-seeking decisions made at tables, the destruction of forests, the drying up of streams, the fragmentation and concretization of mountains and hills, the disruption of the marine ecosystem, especially seagrass meadows; the destruction of other ecosystems for water, electricity, and infrastructure (construction of quarries, concrete plants, dams), the destruction of the habitats of countless plants such as pine, juniper, mastic, and carob, and ultimately, the loss of health in every aspect..." We are here for Bodrum's outcry.

Here we are, facing just one of these crimes: the destruction of an area normally designated as forest, containing olive groves, for hotel construction by Kalyon Holding. Muğla Metropolitan Municipality had filed a lawsuit against the 1/1000 scale conservation-oriented implementation zoning plan and the 1/5000 scale conservation-oriented master zoning plan amendments, which included the project in the Kızılağaç area of ​​Bodrum. The Muğla 1st Administrative Court, in its decision numbered 2025/1518, annulled the zoning plans for the hotel project belonging to Yalıköy Turizm A.Ş., the contractor for Kalyon Holding, as announced to the public on January 16, 2026. The court ruled that the plan amendments were not in accordance with the law, urban planning principles, and public interest, and therefore decided to annul the plans.

On the other hand, immediately behind this, another hotel project belonging to another company within the same holding company is also being considered, in violation of Annex-1 of the Environmental Impact Assessment (EIA) regulation. In a manner seemingly intended to avoid obstacles, the project was approved by the Ministry with capacities listed in Annex 2, and similarly processed locally, and construction continues. As a result, the 308-room project was presented and approved as two separate projects: 248 + 60 rooms. This is just one of hundreds of examples where the law is bent, appearing to comply with regulations. If there are illegal and circumventive actions and procedures, then there is a crime.

WE ASK:

1) How are these construction activities continuing despite the court's cancellation of the plan? Shouldn't the "permit" issued by Bodrum Municipality on April 21, 2025, for "Parcel 8 of Block 305," as stated on the signboard, be revoked?

2) The public should be informed about whether the building permit was issued in accordance with the legal process.

3) If it was issued, why hasn't this been announced to the public?

4) If the site was sealed, how is construction still ongoing?

5) And on what authority is this construction continuing?

6) After we documented with photographs that the construction violated the coastline and dumped materials on the beach that were contrary to its natural structure, and reported this to the municipality, what actions have been taken?

7) Are the claims that there are two separate tourism allocation areas in the region and that the licensing processes for these areas are ongoing true? We demand very clear answers!

8) If there is a second allocation, has a lawsuit been filed against it as well?

9) If not, why not?

In conclusion, the zoning plans that were canceled by Muğla Metropolitan Municipality Mayor Ahmet Aras through a lawsuit are 'the product of persistent administrative and legal pursuit.' We expect the continuation of the process from both Muğla Metropolitan Municipality and Bodrum Municipality.

And we say: Dear people of Bodrum, these lands do not belong only to a handful of environmentally conscious volunteers. These lands belong to you, to us, to all of us, and to all living beings. Bodrum has suffered greatly over the years, been misused, and its nature has been destroyed. As we said at the beginning, the right of each of us to live in peace and a healthy environment is being violated, and the natural, cultural, historical, and social shared heritage of this city is suffering irreversible destruction. The claim of becoming a 'world brand' in the name of tourism is becoming a 'weak statement' with Bodrum losing its identity and uniqueness, filled with identical facilities from all over the world.

Unfortunately, Bodrum doesn't even have a tourism policy. It is managed with project and parcel-based approaches. There is a showcase design, but no policy.

We are once again calling on you to protect this land, saying 'Enough is enough'. We will not give up. Not only here, but all kinds of illegal and unauthorized constructions...

And we will make our voices heard everywhere that is being exploited for profit. We say, 'To live like a tree, alone and free, and like a forest, in brotherhood.' We invite everyone who is in favor of protection and a just life together to join the struggle. There is no salvation alone, either all together or none of us."
