Bodrum Belediyesi, Gölköy Mahallesi Cennetkoy’daki 678 bin metrekarelik alana yapılması planlanan turistik tesis ve rezidans projesi için verdiği inşaat ruhsatı kararı iptal edildi.

Gökburun Yarımadası'nda yer alan ve halk arasında Cennet Koy olarak adlandırılan 678 bin metrekarelik alan özelleştirme İdaresi tarafından satışa çıkartılmış ve bir holding tarafından alınmıştı. Firma turistik tesis ve rezidanslar yapmak için ruhsat almak üzere Bodrum belediyesi'ne başvurmuş, 12 Aralık 2022 tarihinde de Bodrum Belediyesi inşaat ruhsatını onaylamıştı. Firma ruhsatı alır almaz inşaat faaliyetlerine başlamış ve hafriyat kamyonlarıyla inşaat makineleri alana girmişti.

Bodrum Kent Konseyi, TMMOB, STK'lar ruhsat verilmesine tepki gösterip, "neden direnmediniz" diye sormuşlar hatta eleştiriler arasında, "CHP'li Belediye Başkanı Ahmet Aras ve imarla, ruhsat işlerinden sorumlu başkan yardımcısının bu kararının CHP'nin ilkelerine ve Genel Başkan Kemal Kılıçdaroğlu'nun açıklamalarına ters düştüğü" eleştirileri yer almıştı.

Bodrum Belediyesi İmar ve Şehircilik Müdürlüğü ile Plan ve Proje Müdürlüğü'nün bağlı olduğu Bodrum Belediye Başkan Yardımcısı avukat İlknur Ülküm Seferoğlu basın açıklaması yaparak, "biz vermesek hakkımızda soruşturma açılacaktı" demişti. O tarihte koronavirüs tedavisi göre Bodrum Belediye Başkanı Ahmet Aras da uzun bir yazılı açıklamayla süreci anlatmış ve tepkilere yanıt vermişti. Ancak tüm bu açıkalamalara karşın tepkiler dinmemiş, sivil toplum kuruluşlarıyla meslek örgütleri dava açma hazırlığına başlamışlardı.

Bodrum Belediye Başkanı Ahmet Aras bugün belediye binasında basın açıklaması yaparak ruhsatın iptal edildiğini duyurdu. Ayrıca belediyenin sosyal medya hesaplarında da benzer içerikte kamuoyu duyurları yer aldı. Ancak haberimiz yayına verildiği ana kadar (22:07 7.1.2023) Bodrum Belediyesi resmi internet sitesinde ne Belediye Başkanı Ahmet Aras'ın basın toplantısındaki konuşmaları ne de belediyenin sosyal medya hesaplarında yayınlanan söz konusu duyurular yer almadı

Pazartesi resmi başvuru olacak.

Pazartesi gününden itibaren ruhsat iptal kararının resmi olarak ilan edileceği ve ilgili bakanlığın sistemine de işleneceğini belirtildi. Açıklamada, "Almış olduğumuz bu karar gereğince 9 Ocak Pazartesi günü ilgili Bakanlığın MAKS sistemine girilerek ruhsatların iptal işlemi gerçekleştirilecektir" denildi.

Aras'ın basın toplantısı

Bodrum Belediye Başkanı Ahmet Aras basın toplantısındaki açıklamalarında şu ifadeleri kullandı;

. Bodrum Cennetkoy'da verilen inşaat ruhsatına Bodrum'da TMMOB; kent konseyi ve birçok STK tepki gösterdi, ancak biz yasalar çerçevesinde ruhsatı vermiştik. Verilen tüm tepkileri saygı ile karşılıyoruz, biz ruhsatı verirken sadece tapuya ve oradaki şerhlere bakarız, ruhsat verilirken sıkıntı yoktu.

. Ancak buradaki hazine arazisi ve daha önce kendilerinin mirasçı olduğunu belirten bir grubun açtığı davalar vardı. Bu davalar sürerken Özelleştirme İdaresi satışı yapmıştı, Danıştay ise yürütmeyi durdurma kararı vermişti.

. Tüm bunlara rağmen Cumhurbaşkanlığı Kararnamesi ile satış yapıldı ve firma orada yasal izinleri ÇED gerekli değildir raporunu alıp ruhsat müracaatı yaptı. İddia edildiği gibi ruhsat 6 günde değil 1 yıl incelemenin ardından verildi.

. Hiç kimse, belediyeler dahil Danıştay kararları ve Anayasa'nın üzerinde değildir. Bu nedenle örnek kararlara istinaden verdiğimiz ruhsatı iptal ettik. Bundan sonraki süreçte mücadele bir ruhsat işi olmaktan çıkmış, hak, hukuk ve adalet mücadelesine dönüşmüştür. Firma haklı olarak yargıya müracaat edebilir, benim veya belediyenin aleyhinde davalar açabilir. Bu konuda her türlü mücadeleyi vermeye hazırız...

. Bu iptal kararını alırken hiçbir siyasi baskı altında kalmadım, kalmadık, sadece hak ve hukuktan yana olduk. Bu karar Türkiye'de hukukun üstünlüğü açısından bir emsal teşkil edecek, bu konuda her türlü hesabı vermeye hazırım.

2013 yılında Özelleştirme idaresi tarafından CENGİZ İNŞAAT AŞ’ye satılmış bulunan Gölköy Mahallesi Gökburun Mevkii 306/1 parselde gerçekleştirilecek proje için, Belediyemize eksiksiz olarak ibraz edilen belgelere istinaden 12 Aralık 2022 tarihinde verilmiş olan 60 adet yapı ruhsatı; Belediyemizin dün almış olduğu kararla, İPTAL edilmiştir.

İptal gerekçemiz; Söz konusu satışa konu olan arazi ile ilgili olarak HAK SAHİPLİĞİ iddiasında bulunan bir grubun açtığı dava sonucunda Danıştay İdari Dava Daireleri Kurulu’nun verdiği 'Özelleştirmenin İptali' kararının; Özelleştirme Yüksek Kurulu ve Cumhurbaşkanlığı Kararnamesiyle UYGULANMAMASININ, Anayasa’nın 138. Maddesinde belirtilen, YASAMA VE YÜRÜTME ORGANLARI İLE İDARE, MAHKEME KARARLARINA UYMAK ZORUNDADIR. BU ORGANLAR VE İDARE, MAHKEME KARARLARINI HİÇBİR SURETLE DEĞİŞTİREMEZ VE BU KARARLARIN YERİNE GETİRİLMESİNİ GECİKTİREMEZ hükmüdür.

Almış olduğumuz bu karar gereğince 9 Ocak Pazartesi günü ilgili Bakanlığın MAKS sistemine girilerek ruhsatların iptal işlemi gerçekleştirilecektir.

Projede neler var?

Özelleştirme İdaresi’nden satın aldığı 678 bin metrekarelik arazide inşaata başlayacak olan şirket, Muğla Çevre ve Şehircilik İl Müdürlüğü'ne Çevresel Etki Değerlendirme (ÇED) süreci için proje tanıtım dosyası sundu. Buna göre 409 bin metrekare büyüklüğündeki iki parsel üzerinde toplam 100 villa inşa edecek. Otel ise 101 apart ve 83 suit olmak üzere 184 odadan oluşacak. 59 bin 562 metrekare inşaat alanına sahip projenin maliyetinin 568 milyon lira olması bekleniyor. Bir bölümü 2. Derece doğal sit ve 3. Derece arkeolojik sit alan olan arazide geliştirilen projede 1200 kişilik 7 lokanta, 300 kişilik toplantı salonu ve yüzme havuzları yer alacak.

Bodrum Municipality's decision to approve the construction permit for Cennet Bay, which attracted a lot of reaction, was cancelled. Okay but why? The reasons are in the NEWS...

The construction permit decision given by the Bodrum Municipality for the touristic facility and residence project planned to be built on an area of 678 thousand square meters in Cennetkoy, Gölköy District, has been cancelled.
An area of 678 thousand square meters on the Gökburun Peninsula, popularly known as Cennet Bay, was put up for sale by the Privatization Administration and bought by a holding. The company applied to Bodrum Municipality to obtain a license to build touristic facilities and residences, and on 12 December 2022, Bodrum Municipality approved the construction license. As soon as the company got the license, it started construction activities and earthmoving trucks and construction machinery entered the field.

Bodrum City Council, TMMOB, NGOs reacted to the issuance of licenses, asking "why didn't you resist", and even criticized: "The CHP Mayor Ahmet Aras and the vice-president responsible for zoning and licensing decided that this decision was in line with the principles of the CHP and Chairman Kemal Kemal. There were criticisms that Kılıçdaroğlu contradicted his statements.

Deputy Mayor İlknur Ülküm Seferoğlu made a press statement and said, "If we didn't, an investigation would be launched against us," these words drew even more reaction. Bodrum Mayor Ahmet Aras also explained the process in a long written statement and responded to the reactions. However, despite all these explanations, the reactions did not subside and non-governmental organizations and professional organizations started to prepare to file a lawsuit.

Bodrum Mayor, Ahmet Aras, made a press release at the Municipality Building today and announced that the license was cancelled. There were also public announcements with similar content on the social media accounts of the municipality. However, until our news was broadcast (22:07 7.1.2023), the Bodrum Municipality official website did not include the speeches of Mayor Ahmet Aras at the press conference, nor the aforementioned announcement published on the municipality's social media accounts.

There will be an official application on Monday.

It was stated that as of Monday, the decision to cancel the license will be officially announced and will be entered into the system of the relevant ministry. "According to this decision we have taken, the licenses will be canceled by entering the MAKS system of the relevant Ministry on Monday, January 9," the statement said.

Aras's press conference

Bodrum Municipality Ahmet Aras used the following statements in the statement made at the press conference;

. TMMOB in Bodrum for the construction permit given in Bodrum Cennetkoy; The city council and many NGOs reacted, but we had given the license within the framework of the law. We respect all the reactions given, we only look at the title deed and the annotations there while giving the license, there was no problem when issuing the license.

. However, there were lawsuits filed by a group stating that they were the heirs of the treasury land here and before. While these cases were pending, the Privatization Administration made the sale, and the Council of State decided to stay the execution.

. Despite all this, the sale was made with the Presidential Decree and the company received the legal permissions, the EIA is not required report, and applied for a license. As alleged, the license was granted after 1 year of examination, not in 6 days.

. No one, including municipalities, is above the decisions of the Council of State and the Constitution. For this reason, we canceled the license we gave based on the sample decisions. In the next period, the struggle ceased to be a license issue and turned into a struggle for rights, law and justice. The company can rightfully apply to the judiciary and file lawsuits against me or the municipality. We are ready to give any kind of struggle on this issue...

. While taking this annulment decision, I was not under any political pressure, we did not stay, we were only on the side of rights and law. This decision will set a precedent for the rule of law in Turkey, and I am ready to give all kinds of accounts in this regard.

Our reason for cancellation; As a result of the lawsuit filed by a group claiming RIGHT OWNERSHIP regarding the land subject to the sale in question, the 'Cancellation of Privatization' decision of the Council of State Administrative Litigation Chambers; NOT IMPLEMENTED by the Privatization High Council and the Presidential Decree, the LEGISLATIVE AND EXECUTIVE BODIES AND THE ADMINISTRATION HAVE TO FOLLOW THE DECISIONS OF THE COURT, which is stated in Article 138 of the Constitution. THESE BODIES AND THE ADMINISTRATION CANNOT CHANGE THE DECISIONS OF THE COURT IN ANY WAY, AND CANNOT DELAY THE FULING OF THESE DECISIONS.

What's in the project?

The company, which will start construction on a land of 678 thousand square meters purchased from the Privatization Administration, submitted a project introduction file for the Environmental Impact Assessment (EIA) process to the Muğla Provincial Directorate of Environment and Urbanization. Accordingly, a total of 100 villas will be built on two parcels of 409 thousand square meters. The hotel will consist of 184 rooms, including 101 apartments and 83 suites. The cost of the project, which has a construction area of 59 thousand 562 square meters, is expected to be 568 million liras. Developed on the land, part of which is a 2nd degree natural site and a 3rd degree archaeological site, the project will include 7 restaurants for 1200 people, a meeting hall for 300 people and swimming pools.
