Ünlü iş insanı, Gümüşlüklü Karakaya ailesinden, Bodrum Belediye Meclisi'nin CHP'li üyesi Ahmet Faik Karakaya'nın üyeliği, "SİT alanındaki evinde tadilat" gerekçesiyle düşürüldü.
Gümüşlüğün yerlisi, iş insanı, Bodrum Belediye Meclisi'nin CHP'li üyesi Ahmet Faik Karakaya hakkında süre gelen, "SİT alanındaki konutunda tadilat" yoluyla yasaya muhalefet suçlamasıyla açılan davada ceza almıştı. Tüm yargı yollarının tükenmesinin ardından mahkeme kararı İçişleri Bakanlığı ile Yüksek Seçim Kurulu'na (YSK) gönderildi.
Yüksek Seçim Kurulu da Ahmet Faik Karakaya hakkında kesin hükme bağlanan, "SİT alanındaki konutunda tadilat" yoluyla yasaya muhalefet kararı nedeniyle yasalardaki hükümleri uygulayarak Bodrum Belediye Meclisi üyeliğini düşürdü. YSK'nın kararı Karakaya'nın yanı sıra Bodrum Belediyesi'ne tebliğ edildi.
Bu tebligatla birlikte Bodrum Belediye Meclisi’nde Cumhuriyet Halk Partisi adına görev yapan Ahmet Faik Karakaya’nın meclis üyeliği sona erdi ve mazbatası iptal edildi.
Gümüşlüğü en köklü ailelerinden Karakaya'ların son kuşak iş insanı temsilcisi olan Ahmet Faik Karakaya Gümüşlük Spor Kulübünde de başkanlık yaptı. Kulübü as başkan, oyuncu yazar Nejat İşler ve yönetim kurulu üyeleriyle birlikte şampiyon yaptıktan sonra siyasete yönelen Ahmet Faik Karakaya 2024 yerel genel seçimlerinde parti içi ön seçimden gelerek CHP listesinden Bodrum Belediye Meclisi üyesi seçildi.

Mecliste olduğu süre boyunca çeşitli komisyonlarda görev alan, Belediye Başkan vekillği yapan Ahmet Faik Karakaya bir açıklama yayınlayarak durumunu özetledi. Karakaya'nın açıklaması aşağıda;

Yerine kim, nasıl seçilecek?
Mahkeme kararı sonrası üyeliği düşürülen Ahmet Faik Karakaya'nın yerine Bodrum Belediye Meclisi üyeliğine kim, nasıl seçilecek? T.C. Çevre, Şehircilik ve İklim Değişikliği Bakanlığı'nın, "Belediye Meclis Üyeliklerinde boşalan asil üyeliğin yerine yedek üyenin getirilmesi" başlıklı bölümü şöyle;
"... / Öte yandan, Kanunun 28 inci maddesinde belediye meclisi yedek üyelerinin asıl üyeliğe getirilmesiyle ilgili 'Belediye meclisinde asıl üyelikten bir boşalma olduğu takdirde' boşalan üyelik hangi ilçe veya siyasi partiye ait ise, davet edilecek yedek üyenin de, aynı ilçe ve siyasi partiden olacağı, bir partiden boşalan asıl üyelik için, o partiden davet edilecek yedek üye kalmamış ise veya boşalan asıl üyelik bir bağımsıza ait ise, parti ayırımı yapılmaksızın oy bölüşümünde sırası önde gelen yedek üyenin asıl üyeliğe davet edileceği, bir siyasi parti listesinden, meclis asıl üyeliğine seçildikten sonra, başka bir siyasi partiye geçen veya bağımsız kalanlardan asıl üyelik açıldığı takdirde, bu üyelerin meclis üyeliğine seçildikleri sırada mensup oldukları partinin yedek üyesinin, asıl üyeliğe çağırılacağı” hüküm altına alınmıştır.
Buna göre;
1- Belediye meclislerinde boşalan asıl üyelik, boşalan asıl üyeliğin mensubu olduğu siyasi partiye ait yedek üye davet edilerek doldurulmaktadır.
2- Belediye meclislerinde boşalan asıl üyelik için, o partiden davet edilecek yedek üye kalmamış ise veya boşalan asıl üyelik bir bağımsıza ait ise, parti ayırımı yapılmaksızın oy bölüşümünde sırası önde gelen yedek üye asıl üyeliğe davet edilmektedir.
3- Belediye meclislerinde boşalan asıl üyelik için, bir siyasi parti listesinden meclis asıl üyeliğine seçildikten sonra, başka bir siyasi partiye geçen veya bağımsız kalanlardan asıl üyelik açıldığı takdirde, bu üyelerin meclis üyeliğine seçildikleri sırada mensup oldukları partinin yedek üyesi çağırılmaktadır.
4- Büyükşehir belediye meclislerinde boşalan asıl üyelik, boşalan asıl üyeliğin mensubiyetine bakılmaksızın her ilçe belediyesi için seçilmiş olan asıl üyelerin seçiliş sıralarına göre baştan başlayarak yeter sayıya kadar inilmek suretiyle davet edilerek doldurulmaktadır."

Karakaya's membership was revoked
The membership of Ahmet Faik Karakaya, a famous businessman and CHP member of the Bodrum Municipality Council from the Karakaya family from Gümüşlük, was revoked due to "renovations in his house in a protected area".
Ahmet Faik Karakaya, a native of Gümüşlük, a businessman and CHP member of the Bodrum Municipality Council, was sentenced in the ongoing case filed against him on charges of "violating the law by renovating his house in a protected area". After all legal remedies were exhausted, the court decision was sent to the Ministry of Interior and the Supreme Election Council (YSK).
The Supreme Election Council also revoked the Bodrum Municipality Council membership by applying the provisions of the law due to the final decision made regarding Ahmet Faik Karakaya's "violating the law by renovating his house in a protected area". The YSK notified Karakaya of the decision as well as the Bodrum Municipality of Bodrum.
With this notification, the council membership of Faik Karakaya, who was serving on behalf of the Republican People's Party in the Bodrum Municipality Council, ended and his certificate was revoked.
Ahmet Faik Karakaya, the last businessman representative of the Karakayas, one of the most deep-rooted families in Gümüşlük, was also the president of Gümüşlük Sports Club for a period. Ahmet Faik Karakaya, who turned to politics after making the club a champion, was elected as a Bodrum Municipal Council member from the CHP list in the 2024 local general elections through an intra-party primary election.

Ahmet Faik Karakaya, who served on various commissions and served as Deputy Mayor during his time in the council, released a statement summarizing his situation. Karakaya's statement is below;
Who will be elected and how?
Who will be elected as a Bodrum Municipal Council member instead of AHmet Faik Karakaya, whose membership was revoked after the court decision? The section of the Ministry of Environment, Urbanization and Climate Change of the Republic of Turkey titled "Application of substitute members to replace vacant full members in Municipal Council Memberships" is as follows;
"... / On the other hand, in Article 28 of the Law, regarding the appointment of substitute members of the municipal council to the main membership, it is stipulated that 'in case of a vacancy from the main membership in the municipal council', the substitute member to be invited will be from the same district and political party to which the vacant membership belongs, and if there are no substitute members to be invited from that party for the main membership vacated by a party or if the vacant main membership belongs to an independent, the substitute member who is ahead in the vote distribution will be invited to the main membership without making any party distinction, and if a main membership is opened from those who have transferred to another political party or remained independent after being elected as the main membership from a political party list, the substitute member of the party to which these members were affiliated when they were elected as the main membership will be invited to the main membership.
Accordingly;
1- The vacant main membership in the municipal councils is filled by inviting the substitute member of the political party to which the vacant main membership belongs.
2- If there are no substitute members to be invited from that party for a vacant main membership in municipal councils or if the vacant main membership belongs to an independent, the substitute member who is ahead in the vote distribution is invited to the main membership, regardless of party distinction.
3- If a main membership is opened for a vacant main membership in municipal councils from a political party list, after being elected as a main member of the council, and then switching to another political party or remaining independent, the substitute member of the party to which these members were affiliated when they were elected as a member of the council is invited.
4- In metropolitan municipal councils, the vacant main membership is filled by inviting the main members elected for each district municipality, starting from the beginning, and descending until the quorum is reached, regardless of the affiliation of the vacant main membership.
