Basın, sosyal medya ve internet haberciliğine ilişkin düzenlemeleri içeren Basın Kanunu ile Bazı Kanunlarda Değişiklik Yapılmasına Dair Kanun Teklifi, TBMM Adalet Komisyonu’nda kabul edildi.

Komisyonda kabul edilen teklife göre, yasal zemine kavuşturulmaları amacıyla internet haber siteleri ile basın kartına ilişkin hususlar Basın Kanunu kapsamına alındı. Teklifle internet haber siteleri de süreli yayın tanımı kapsamına alınacak.

İletişim bilgileri

İnternet haber sitelerinde faaliyet gösterdiği iş yeri adresi, ticari unvanı, elektronik posta adresi, iletişim telefonu ve elektronik tebligat adresi ile yer sağlayıcısının adı ve adresi kendilerine ait internet ortamında kullanıcıların ana sayfadan doğrudan ulaşabileceği şekilde ve “iletişim” başlığı altında bulundurulacak.

İnternet haber sitelerinde bir içeriğin ilk kez sunulmaya başlandığı tarih ile sonraki güncelleme tarihleri, her erişildiğinde değişmeyecek şekilde içeriğin üzerinde belirtilecek.

Süreli yayın beyannamesi

Basın duyurularının ve yargı organlarınca verilen yayın yasağı kararlarının hızlı ve etkin bir şekilde tebliğinin sağlanması amacıyla; süreli yayınların çıkarılması için, kaydedilmek üzere verilecek beyanname artık Cumhuriyet Başsavcılığı yerine Basın İlan Kurumu’na verilecek. Kayıt için verilen beyannamede elektronik tebligat adresi de gösterilecek.

Kanun teklifinin yürürlüğe girdiği tarihten önce faaliyet gösteren internet haber siteleri, kanunun yürürlüğe girdiği tarihten itibaren üç ay içinde yükümlülüklerini yerine getirmek zorunda olacak.

Düzenlemenin yürürlüğe girdiği tarihten önce yayımlanmakta olan süreli yayınlarla ilgili olarak Cumhuriyet Başsavcılıklarında bulunan kayıtlar, Basın İlan Kurumu’na 3 ay içinde devredilecek.

İnternet haber sitelerinde resmi ilan ve reklamlar

Basın İlan Kurumu Genel Müdürlüğü, her ayın sonunda resmi ilan ve reklam verilebilecek olan mevkuteler ile internet haber sitelerinin isimlerini ve vasıflarını ihtiva eden birer listeyi, kurumun internet siteleri üzerinden duyuracak.

Teklifle internet haber sitelerinde yayınlanacak resmi ilan ve reklamların kapsam ve esasları da belirlenecek. Böylece internet haber sitelerinde resmi ilan ve reklamların Basın İlan Kurumu aracılığıyla yayınlanabilmesine imkan sağlanacak.

Basın İlan Kurumu aracılığıyla yayınlanan ilanların kopyalanması veya ticari faaliyete konu edilmesi durumlarına dair usul ve esasların tespit edilmesi için Genel Kurula yetki veriliyor. Kamuya ait ilanlara vatandaşların tek merkezden kolayca ulaşabilmesi amacıyla Basın İlan Kurumu İlan Portalı’na hukuki statü kazandırılıyor.

Buna göre, Resmi Gazete’de yayımlananlar hariç olmak üzere Kanun, Cumhurbaşkanlığı Kararnamesi ve yönetmelikler uyarınca yayınlatılması mecburi olan resmi ilanlar ile daire ve teşekküller, kanun veya Cumhurbaşkanlığı Kararnamesiyle kurulan sair müesseseler veya bunların iştiraklerinin internet haber sitelerinde yayınlatacakları ilan ve reklamlar ancak Basın İlan Kurumu aracılığı ile yayınlanacak.

Kurum aracılığıyla yayınlanan ilan ve reklamların, kopyalanması, yayınlanması, yayınlattırılması ve ticari faaliyete konu edilmesi Kurumun vereceği izne bağlı olacak.

Cumhurbaşkanlığına bağlı kurum ve kuruluşlar ile Bakanlıklar, bağlı, ilgili veya ilişkili kurum ve kuruluşlar, diğer kurum ve kuruluşların kendi internet sitesinde yayını zorunlu olan ilanlarının ayrıca Basın İlan Kurumu İlan Portalı’nda yayınlatılması zorunlu olacak.

İnternet haber sitelerinde resmi ilan ve reklam yayınlatılması

İnternet haber sitelerinde resmi ilan ve reklam yayınlatılması görevi Basın İlan Kurumu’na verildiğinden, gazete ve dergiler için uygulanan müeyyideler internet haber sitelerine de uygulanacak.

Müeyyide uygulanan gazete, dergi ve internet haber sitelerinin başvuracağı yargı mercisi konusunda tereddütlerin giderilmesi amacıyla başvurulacak mahkeme yeri, Basın İlan Kurumu Genel Müdürlüğü’nün bulunduğu yerdeki asliye hukuk hakimliği olarak değiştirilecek, 15 gün olan mahkemenin karar verme süresi kaldırılarak konuya ilişkin basit yargılama usulü getirilecek.

BİK Yönetmelik Yayınlayacak

Yönetim Kurulu kararına karşı, kararın tebliğinden itibaren 10 gün içinde Basın İlan Kurumu Genel Müdürlüğü’nün bulunduğu yerdeki asliye hukuk hakimliğine itiraz edilebilecek.

İnternet haber sitelerinde resmi ilan ve reklam yayınlayacakların sorumluluklarına da kanun teklifinde yer veriliyor.

İnternet haber sitelerinde resmi ilan ve reklam yayınlayacakların taşıması gereken vasıflar ve yerine getirmesi gereken sorumluluklar ile yayına ilişkin usul ve esaslar teklifin yürürlüğe girdiği tarihten itibaren Basın İlan Kurumu Genel Kurulunca 6 ay içinde çıkarılacak yönetmelikle belirlenecek.

BİK Genel Kurul üye sayısı

Teklifle 36 kişiden oluşan Basın İlan Kurumu Genel Kurulu’na, resmi ilan yayınlayacak internet haber sitelerinden 2, Cumhurbaşkanı’nca belirlenecek 2, radyo, televizyon ve internet siteleriyle ilgili işlemler gerçekleştiren BTK ile RTÜK’ten 2 temsilci eklenecek. Genel Kurul üye sayısı 42’ye çıkacak.

Teklifle, Kurumun ülke genelinde görevli olmasıyla tüm Anadolu gazetelerinin kayıtları Basın İlan Kurumu’nda tutulduğundan, Anadolu gazete sahipleri temsilcileri seçimi İletişim Başkanlığı yerine Basın İlan Kurumu Genel Müdürlüğünce düzenlenecek.

Anadolu gazete sahiplerinin Genel Kurula katılacak temsilcileri, resmi ilan yayınlayan Anadolu gazete sahiplerinin ya da bu gazetelerin ayrı ayrı gösterecekleri temsilcilerinin Genel Müdürlüğün çağrısı üzerine katılacakları toplantıda farklı coğrafi bölgelerden olmak üzere seçilecek. Yeni üyeler belirlenene kadar mevcut üyelerin görevleri devam edecek.

The Draft Law on the Amendment of the Press Law and Some Laws, which includes the regulations regarding the press, social media and internet journalism, was accepted by the Parliamentary Justice Committee.

According to the proposal accepted by the commission, the issues related to internet news sites and press cards were included in the scope of the Press Law in order to provide them with a legal basis. With the proposal, internet news sites will also be included in the definition of periodicals.

The workplace address, trade name, e-mail address, contact phone and electronic notification address, as well as the name and address of the hosting provider on the internet news sites will be kept under the "contact" heading in a way that users can directly access from the home page.

The date when a content is first presented on internet news sites and the next update dates will be indicated on the content, in a way that will not change each time it is accessed.

Periodical statement

In order to ensure that press releases and broadcast ban decisions given by judicial bodies are communicated quickly and effectively; For the publication of periodicals, the declaration to be submitted for registration will now be given to the Press Advertisement Agency instead of the Office of the Chief Public Prosecutor. The electronic notification address will also be shown in the declaration submitted for registration.

Internet news sites operating before the effective date of the bill will have to fulfill their obligations within three months from the effective date of the law.

The records at the Office of the Chief Public Prosecutor regarding the periodicals published before the effective date of the regulation will be transferred to the Press Announcement Agency within 3 months.

Official advertisements and advertisements on internet news sites

At the end of each month, the General Directorate of Press Advertisement Institution will announce a list containing the names and qualifications of the positions and internet news sites on which official announcements and advertisements can be placed, on the internet sites of the institution.

With the proposal, the scope and principles of official announcements and advertisements to be published on internet news sites will also be determined. Thus, it will be possible to publish official announcements and advertisements on internet news sites through the Press Advertisement Agency.

The General Assembly is authorized to determine the procedures and principles regarding the copying or commercial activity of the advertisements published through the Press Advertisement Agency. In order for citizens to easily access public announcements from a single center, the Press Announcement Agency Announcement Portal is given a legal status.

Accordingly, except for those published in the Official Gazette, official announcements that are required to be published in accordance with the Law, Presidential Decree and regulations, and announcements and advertisements to be published on the websites of departments and organizations, other establishments established by law or Presidential Decree or their affiliates can only be published through the Press Advertisement Institution. will be published with

The copying, publishing, broadcasting and commercial activity of the advertisements and advertisements published through the Institution shall be subject to the permission of the Institution.

The announcements of the institutions and organizations affiliated to the Presidency, the Ministries, affiliated, related or related institutions and organizations, other institutions and organizations whose publication is compulsory on their own website will also be mandatory to be published on the Press Advertisement Agency Announcement Portal.

In order to eliminate the hesitations about the judicial authority to which the sanctioned newspapers, magazines and internet news sites will apply, the place of court will be changed to the court of first instance in the place where the General Directorate of Press Advertisement Agency is located.

Against the decision of the Board of Directors, within 10 days from the notification of the decision, an objection can be made to the court of first instance in the place where the General Directorate of Press Announcement Agency is located.

The responsibilities of those who will publish official announcements and advertisements on internet news sites are also included in the bill.

The qualifications and responsibilities of those who will publish official announcements and advertisements on internet news sites, as well as the procedures and principles regarding the publication will be determined by the regulation to be issued by the General Assembly of the Press Advertisement Institution within 6 months from the effective date of the proposal.

Number of RCC General Assembly members

With the proposal, 2 of the internet news sites that will publish official announcements, 2 to be determined by the President, radio, television and internet, were submitted to the General Assembly of the Press Advertisement Institution, which consists of 36 people.

2 representatives from BTK and RTÜK, which carry out transactions related to their websites, will be added. The number of members of the General Assembly will increase to 42.

With the proposal, since the records of all Anatolian newspapers are kept in the Press Advertisement Institution, with the Authority being in charge throughout the country, the election of the representatives of Anatolian newspaper owners will be organized by the General Directorate of the Press Advertisement Institution instead of the Directorate of Communications.

The representatives of Anadolu newspaper owners who will attend the General Assembly will be selected from different geographical regions at the meeting, which will be attended by Anadolu newspaper owners who have published official advertisements or the representatives of these newspapers separately, upon the call of the General Directorate. The duties of existing members will continue until new members are determined.
