11 Mayıs 2011’de İstanbul’da imzaya açıldığı için "İstanbul Sözleşmesi" olarak anılan, "Kadınlara Yönelik Şiddet ve Aile İçi Şiddetin Önlenmesi ve Bunlarla Mücadeleye İlişkin Avrupa Konseyi Sözleşmesi"ne ilk imzayı atan Türkiye, 20 Mart 2021 günü Cumhurbaşkanlığı kararnamesiyle sözleşmeyi iptal etti. Kararnamenin iptali ve yürütmenin durdurulması istemiyle çok sayıda dava açıldı.
Danıştay 10. Dairesi, açılan davalarda yürütmenin durdurulması istemlerini reddetti; kararın iptal istemiyle açılan davaları duruşmalı olarak gördü. Danıştay Savcısı, kararın iptali yönünde görüş bildirdi. Danıştay 10. Dairesi, görülen dört duruşmada tarafların ve Danıştay savcısının görüşlerini aldı ve ardından Temmuz 2022’de kararını açıkladı.
Danıştay, Cumhurbaşkanlığı kararını hukuka uygun buldu ve davanın reddine karar verdi. Bunun üzerine davacılar kararı temyiz etti. Danıştay İdari Dava Daireleri Kurulu'na taşınan dosyada son karar verildi ve temyiz itirazlarının reddine karar verildi. Böylece, Türkiye İstanbul Sözleşmesi'nden resmen ayrılmış oldu.

Istanbul Convention is officially over
The Council of State made its decision on the Istanbul Convention. Turkey officially exited the Istanbul Convention.
Turkey, which was the first to sign the "Council of Europe Convention on Preventing and Combating Violence Against Women and Domestic Violence", which is known as the "Istanbul Convention" because it was opened for signature in Istanbul on May 11, 2011, canceled the agreement with a presidential decree on March 20, 2021. . Numerous lawsuits were filed for the annulment of the decree and the stay of execution.
The 10th Chamber of the Council of State rejected the requests for a stay of execution in the cases brought; considered the lawsuits filed for the annulment of the decision as hearing. The Prosecutor of the Council of State expressed an opinion in the direction of annulment of the decision. The 10th Chamber of the Council of State received the views of the parties and the Prosecutor of the Council of State in the four hearings, and then announced its decision in July 2022.
The Council of State found the Presidential decision to be lawful and decided to reject the case. The plaintiffs then appealed the decision. The final decision was made in the file that was transferred to the Council of State Administrative Case Divisions and it was decided to reject the appeal objections. Thus, Turkey officially left the Istanbul Convention.
