TBMM'de görüşülerek yasalaştı

Gümüşlük Haber Ajansı (GHA) - 02.02.2023 - Sözleşmeli araştırma görevlilerinin kadroya alınması, MİT Akademisi kurulması teklifleri TBMM'de yasalaştı. Bazı üniversitelerin isimleri değişirken disiplin cezaları da yeniden düzenlendi.

TBMM'de kabul edilen kanun tekliflerine göre yükseköğretim kurumlarında çalışan 50/d'li araştırma görevlilerinin 33/a kapsamına alınmasına ilişkin düzenleme yer alıyor. Tezli yüksek lisans veya doktora, sanatta yeterlik eğitimine devam eden veya bu eğitimlerini tamamlamış araştırma görevlileri, düzenlemenin yürürlüğe girdiği tarihten itibaren 6 ay içinde talep etmeleri halinde kadrolarının bulunduğu üniversite tarafından araştırma görevlisi kadrosuna atanacak. Ancak tıp, diş hekimliği, eczacılık ve veteriner hekimlikte uzmanlık eğitimi yapmakta olanlar ve bu eğitimlerini tamamlamış olanlar hariç tutuldu.

Disiplin cezaları

Yasayla, yükseköğretim kurumlarındaki disiplin cezaları ve disiplin cezalarını gerektiren disiplin suçları ayrıntılı bir şekilde yeniden düzenlendi. Disiplin soruşturmasına, disipline konu olay öğrenilince derhal başlanılacak ve soruşturma en geç 30 gün içinde sonuçlandırılacak. Soruşturma bu süre içinde tamamlanamazsa soruşturmacı gerekçeli olarak ek süre talep edebilecek.

Kınama ile yükseköğretim kurumundan bir haftadan bir aya kadar uzaklaştırma cezalarında 1 ay içinde; yükseköğretim kurumundan 1 veya 2 yarıyıl için uzaklaştırma ile yükseköğretim kurumundan çıkarma cezalarında 3 ay içinde disiplin soruşturmasına başlanmadığı takdirde, disiplin cezası verme yetkisi zaman aşımına uğrayacak.

Disiplin cezasını gerektiren eylemlerin işlendiği tarihten itibaren en geç 2 yıl içinde disiplin cezası verilmediği takdirde, disiplin cezası verme yetkisi zaman aşımına uğrayacak.

Hakkında disiplin soruşturması açılan öğrenciye, isnat edilen suçun neden ibaret olduğu, savunmasını yapacağı tarihten en az 7 gün önce yazılı olarak bildirilecek. Öğrenci, savunmasını sözlü ya da yazılı olarak yapabilecek.

Disiplin cezası verilen bir eylemin, disiplin ceza zamanaşımı süresi içerisinde tekerrüründe bir derece ağır ceza uygulanacak. Disiplin suçunun tekerrürü gerekçesiyle yükseköğretim kurumundan çıkarma cezası verilemeyecek.

Üniversite isimleri

Beykent Üniversitesinin adı "İstanbul Beykent Üniversitesi"; Alanya Hamdullah Emin Paşa Üniversitesi'nin adı "Alanya Üniversitesi"; Antalya AKEV Üniversitesinin adı "Antalya Belek Üniversitesi"; Nişantaşı Üniversitesinin adı "İstanbul Nişantaşı Üniversitesi"; Nişantaşı Meslek Yüksekokulunun adı ise "İstanbul Nişantaşı Meslek Yüksekokulu" olarak değiştirilecek.

MİT Akademisi

Milli İstihbarat Teşkilatı (MİT) bünyesinde; Milli İstihbarat Akademisi adıyla, istihbarat ve milli güvenlik ile ilgili alanlarda lisansüstü eğitim-öğretim, bilimsel araştırma ve yayın yapmak üzere yükseköğretim kurumu kurulacak. Milli İstihbarat Akademisinin akademik ve idari teşkilatlanması, çalışma usul ve esasları ile diğer hususlar, MİT tarafından hazırlanan ve Cumhurbaşkanı tarafından onaylanan yönetmelikle belirlenecek.

Staffing for contracted academic staff became law

Proposals to recruit contracted research assistants and establish the MIT Academy were enacted in the Turkish Grand National Assembly.

According to the law proposals accepted in the Parliament, there is a regulation regarding the inclusion of 50/d research assistants working in higher education institutions into the scope of 33/a. Research assistants who continue or have completed their master's or doctorate with thesis, proficiency in art education, will be appointed to the staff of research assistants by the university they hold their cadres, if they request it within 6 months from the effective date of the regulation. However, those who are doing specialization training in medicine, dentistry, pharmacy and veterinary medicine and those who have completed this training were excluded.

Disciplinary measures

With the law, disciplinary punishments in higher education institutions and disciplinary offenses requiring disciplinary punishments were rearranged in detail. Disciplinary investigation will be initiated as soon as the event subject to the discipline is learned and the investigation will be concluded within 30 days at the latest. If the investigation cannot be completed within this period, the investigator may request additional time with justification.

Within 1 month in the punishments of reprimand and suspension from the higher education institution from one week to one month; If a disciplinary investigation is not initiated within 3 months, the authority to impose disciplinary punishment will expire.

If disciplinary punishment is not given within 2 years at the latest from the date of committing the acts that require disciplinary punishment, the authority to impose disciplinary punishment will expire.

The student, about whom a disciplinary investigation has been initiated, will be notified in writing at least 7 days before the date on which he will make his defense, of what the alleged crime is. The student will be able to make his defense orally or in writing.

In case of repetition of a disciplinary action within the disciplinary penalty statute of limitations, a severe penalty will be applied. The penalty of expulsion from the higher education institution will not be imposed on the grounds that the disciplinary offense is repeated.

University names

Beykent University is called "Istanbul Beykent University"; Alanya Hamdullah Emin Paşa University is called "Alanya University"; Antalya AKEV University is called "Antalya Belek University"; The name of Nisantasi University is "Istanbul Nisantasi University"; The name of Nişantaşı Vocational School will be changed to "Istanbul Nişantaşı Vocational School".

MIT Academy

Within the National Intelligence Organization (MIT); A higher education institution will be established under the name of the National Intelligence Academy to conduct postgraduate education, scientific research and publications in the fields of intelligence and national security. The academic and administrative organization of the National Intelligence Academy, working procedures and principles and other issues will be determined by a regulation prepared by the MIT and approved by the President.
